Do you have to pay out unused annual leave when someone leaves?

Yes. When an employee leaves, they are legally entitled to be paid for any annual leave they have accrued but not taken. This applies regardless of whether they resign, are made redundant, or are dismissed. The payment should be at their normal rate of pay.

Can you deduct pay if an employee has taken more leave than they have accrued?

If an employee leaves having taken more annual leave than they have accrued up to their leaving date, you may be able to reclaim the overpayment from their final wages - but only if your employment contract expressly permits this. Without a specific contractual clause, deducting from final pay is not straightforward. Take HR advice if you are unsure.

What counts as the last working day?

The last working day is the final day the employee is contracted to work, which may be different from their notice period end date if they are on garden leave. Use the last day they are actually working for the purposes of this calculation.

What about carry-forward leave?

Some employers allow unused annual leave to be carried forward into the next leave year. If the employee has carry-forward days that have not yet expired, these should be included in the calculation. Check your leave policy for any expiry dates on carried-forward leave.
